These Terms apply to all visitors, users, registrants, leads, clients, and others who access or use the Service. By accessing, using, or registering on the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

Accounts:

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Consent to Communications:

By registering on the Service, submitting your contact information through any form on the Service, or otherwise engaging with WIRE Miami, you expressly consent to be contacted by WIRE Miami and its licensed real estate associates via telephone call (including automated dialing and pre-recorded messaging), text message (SMS/MMS), email, and any other electronic means, at any telephone number or email address you provide, even if your telephone number is listed on a corporate, state, or the National Do Not Call Registry.

To opt out of communications, you may reply “STOP” to any text message, click the unsubscribe link in any email, or contact us at [email protected]. Message and data rates may apply. Message frequency may vary.

Consent to Call Recording and Communication Monitoring

By registering on the Service, submitting your contact information, or otherwise engaging in communications with WIRE Miami or any of its licensed real estate associates, you expressly consent to the recording and monitoring of all telephone calls, text messages, and other electronic communications conducted through WIRE Miami’s communication systems.

WIRE Miami may record telephone conversations and retain records of text messages and emails for the following purposes:

Quality assurance and service improvement
Internal compliance and regulatory purposes
Training and professional development
Verification of transaction details and client instructions
Resolution of disputes
Protection of the legal rights of WIRE Miami, its associates, and its clients

This consent applies to all communications conducted through WIRE Miami’s telephone systems, CRM platforms, email systems, and any other communication tools provided or used by WIRE Miami in the course of its business. This consent is provided in compliance with Florida Statute §934.03 and constitutes your knowing and voluntary agreement to the recording and monitoring of communications as described herein.

If you do not consent to the recording of your communications, you must notify WIRE Miami in writing at [email protected] before engaging in any telephone or electronic communication with WIRE Miami or its associates. Continued communication with WIRE Miami after registration constitutes ongoing consent to recording and monitoring.

SMS Terms and Conditions

We use SMS to confirm appointments, send reminders, and notify clients of schedule updates or important changes.
You can cancel the SMS service at any time by texting “STOP.” After you send the SMS message “STOP,” we will send a confirmation that you have been unsubscribed. You will no longer receive SMS messages from us unless you re-register.

Carriers are not liable for delayed or undelivered messages.
Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. Contact your wireless provider with questions about your text or data plan.

Intellectual Property

The Service and its original content, features, functionality, design, text, graphics, logos, and all related intellectual property are and will remain the exclusive property of WIRE Miami and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of WIRE Miami.

IDX / MLS Listing Content

WIRE Miami shall hold no liability or responsibility with respect to images and content on the Service that appear as a result of MLS/IDX listings or via any third party. In the event of an issue or problem with such images or content, any legal matters should be directed to the third party that placed such image or content on the IDX or MLS system. You agree to indemnify and hold WIRE Miami and its affiliates harmless from and against any and all losses, liabilities, claims, charges, actions, proceedings, demands, judgments, settlements, costs, and expenses (including attorneys’ fees) arising out of WIRE Miami’s use of IDX/MLS listings.

Links to Other Websites

The Service may contain links to third-party websites or services that are not owned or controlled by WIRE Miami. WIRE Miami has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that WIRE Miami shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

User Data and Lead Information

By registering on the Service or submitting your contact information, you acknowledge that your information will be entered into WIRE Miami’s customer relationship management (CRM) system and may be used by WIRE Miami and its licensed real estate associates to provide you with real estate services, market information, property recommendations, and related communications. All user data collected through the Service is the proprietary property of WIRE Miami.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us at [email protected]. All provisions of the Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, limitations of liability, and consent to call recording.

Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

WIRE Miami does not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or the server that makes it available are free of viruses or other harmful components. Property information displayed on the Service, including pricing, availability, and descriptions, is believed to be accurate but is not guaranteed and should be independently verified.

Limitation of Liability

In no event shall WIRE Miami, its directors, officers, employees, affiliates, agents, contractors, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

Indemnification

You agree to defend, indemnify, and hold harmless WIRE Miami and its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Service.

Governing Law and Venue

These Terms shall be governed and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Miami-Dade County, Florida for any disputes arising out of or relating to these Terms or the Service.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
